Terms and Conditions for Charge EV
1. Introduction
These Terms and Conditions ("T&Cs") govern your use of the Charge EV online store at chargeev.com.au (the "Website"), operated by Infinity EV Pty Ltd (ABN [44 681 163 879], "Infinity EV") trading as Charge EV ("Charge EV," "we," "us," or "our"). The Website facilitates the sale of electric vehicle (EV) chargers, EV charger accessories, Powersensor, Pulsepoint, and related products ("Products").
By browsing the Website, creating an account, placing an order, or otherwise interacting with our services, you agree to be bound by these T&Cs, our Privacy Policy (available at [link to privacy policy]), and any other referenced policies. If you do not agree, you must cease using the Website immediately.
These T&Cs are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of Victorian courts. They comply with Australian Consumer Law (ACL) under Schedule 2 of the Competition and Consumer Act 2010 (Cth), the Fair Trading Act 2012 (Vic), and the Electronic Transactions (Victoria) Act 2000, which validates electronic contracts and signatures for online transactions.
We may update these T&Cs at our discretion. Changes will be posted on the Website, and your continued use constitutes acceptance. Check periodically for updates.
2. User Eligibility and Account Registration
Eligibility: You must be at least 18 years old, reside in Australia (or a supported delivery area), and have the legal capacity to enter contracts. We do not sell to minors or those unable to form binding agreements.
Accounts: Registration may be required for purchases or features. Provide accurate, current information. You are responsible for safeguarding your password and any activities under your account. Notify us immediately of unauthorised access.
Suspension/Termination: We may suspend or terminate your account without notice or liability if you breach these T&Cs, provide false information, or engage in fraudulent activity. Upon termination, access rights cease, but obligations (e.g., payment) survive.
3. Products, Pricing, and Availability
Product Descriptions: We strive for accurate descriptions, images, and specifications, but errors may occur (e.g., typographical or photographic). Products are subject to availability and may be discontinued without notice.
EV-Specific Details: Products comply with Australian safety standards, including AS/NZS 3000:2018 (Wiring Rules) and AS/NZS 3820:2020 for EV charging equipment. However, compatibility with your vehicle or setup is your responsibility—consult a qualified electrician.
Pricing: Prices are in Australian Dollars (AUD), inclusive of GST where applicable, but exclude shipping. We may change prices without notice, but confirmed orders are honored at the quoted price. Promotions are subject to terms and may be withdrawn.
Taxes and Duties: You are responsible for any additional taxes, duties, or fees for international orders (if offered).
4. Ordering and Payment
Order Process: Orders are placed via the Website's checkout. Submission constitutes an offer to purchase; we may accept or reject at our discretion (e.g., due to stock issues). Acceptance occurs upon order confirmation email.

6. Returns, Refunds, and Consumer Guarantees
ACL Guarantees: Nothing in these T&Cs excludes your rights under ACL. Products come with guarantees that cannot be excluded, including acceptable quality, fitness for disclosed purpose, and matching descriptions. For major failures, you may choose refund, replacement, or repair; for minor issues, we choose the remedy.
Returns for Faults: If a Product is faulty, not as described, or breaches ACL guarantees, contact us within [e.g., 14 days] of receipt with proof. We will assess and provide repair, replacement, or refund (including shipping costs) at our discretion, per ACL.
Change of Mind Returns: We do not offer refunds or exchanges for change of mind, incorrect selection, or non-use, unless required by law. This does not affect ACL rights.
Process: Return Products in original condition with packaging and proof of purchase. You bear return shipping costs unless the issue is our fault. Refunds are processed to original payment method within [e.g., 10 business days].

8. User Conduct and Content
Acceptable Use: Do not misuse the Website (e.g., hacking, viruses, spam). Comply with laws; no unlawful, harmful, or infringing activity.
User-Generated Content: If you submit reviews or content, you grant us a perpetual, royalty-free license to use it. We may moderate or remove content without liability.
Prohibitions: No scraping, unauthorized access, or interference with the Website.
9. Disclaimers and Limitation of Liability
Disclaimers: The Website and Products are provided "as is." We disclaim all warranties beyond ACL guarantees, including for accuracy, timeliness, or uninterrupted access. Third-party links are not endorsed.
Limitation: To the maximum extent permitted by law, our liability is limited to resupplying the Product or refunding its cost. We exclude liability for indirect, consequential, or special damages (e.g., lost profits, data loss), even if advised of possibility. This does not limit ACL rights or liability for personal injury/death caused by our negligence.
Force Majeure: We are not liable for delays or failures due to events beyond control (e.g., strikes, pandemics).
EV-Specific: We are not liable for installation, compatibility, or use-related issues. Professional installation is required for safety and compliance.
10. Privacy and Data
We collect and handle personal information per our Privacy Policy and Australian Privacy Principles under the Privacy Act 1988 (Cth). By using the Website, you consent to such handling.
11. Dispute Resolution
